Agreement between you and Grand Stores LLC

 Thank you for signing up as a Nikon Premium Member and for visiting www.npm-mea.com (the "Website"). Please read these terms and conditions carefully before you start to use the Website and avail the benefits of this program. By accessing and using this Website, you indicate that you accept (unconditionally and irrevocably) these terms and conditions (the 'Agreement'). If you do not agree to these terms and conditions, please refrain from using our Website and exit immediately.

You promise to us you are old enough to enter legally binding contracts through this Website and you represent and warrant that you possess the legal right and ability to enter into this Agreement and to use this program and website in accordance with all terms and conditions herein.

Please also make sure that you have read and accept our Privacy Policy.
 

Article 1 – Subject Matter 

Nikon premium Member (NPM) is a loyalty program operated and managed by Grand Stores LLC on behalf of Nikon Middle East FZEa limited liability company incorporated and existing under the federal laws of the United Arab Emirates, and the local laws and regulations of the Emirate of Dubai, registered under trade license no. 207599, having its address at P.O. Box 2144, Dubai, United Arab Emirates. The Nikon premium Member loyalty program is available at all of GrandStores retail outlets across the UAE. These terms and conditions relate to the membership, earning, redeeming and rules of the Nikon Premium member program.


Article 2 – Terms and conditions acceptance 

The use of the Nikon Premium Member loyalty card and subsequently subscribing to the program signifies the unconditional acceptance of the following terms and conditions that the subscriber acknowledges having read and accepted at the time of Nikon Premium Member registration.


Article 3 – Membership 

The Nikon Premium Member loyalty card is free of charge for life and is immediately available upon the purchase of any Nikon Full Frame Cameras or the Nikon D500 or any NIKKOR lenses worth USD 1,350 or more (hereafter known as the Nikon Premium Products). It is strictly one NPM account per person however the NPM numbers/ loyalty cards can be numerous because these correlate to each product purchased and need to be linked to the primary account immediately after purchase.  

To join the Nikon Premium Member program, the subscriber must be registered on the NPM website www.npm-mea.com. This can also be done in store at the time of purchase itself with the help of the retail staff.  The online/onsite registration must be done within 90 days following the purchase of the first Nikon Premium Product failing which Grand Stores reserves the right to deny the subscriber access to the Nikon Premium Member program and all the benefits it entails.

The Nikon Premium Memberloyalty card cannot be duplicated and/or used for any purposes other than those provided for in these terms and conditions. The loyalty card cannot be transferred or used by anyone other than its subscriber/member himself, for any reason. 


Article 4 – Earning
 

Upon registration as a Nikon Premium Member for the first time (New account opening) every member is entitled for the following for benefits: 

o    Seats are limited to only 15 per month for the entire region where the program is available and will be booked on a first come, first served basis.

o    All travel bookings will be handled by the travel agency/ partner appointed by Nikon starting with Musafir LLC in September 2017. Once the booking form on the NPM website is filled out by a consenting member, the form will be forwarded to the appointed travel partner and a designated travel representative will get in touch with the member to plan the booking.  The member is allowed a certain degree of flexibility with the choice of flights (direct/ connecting) as long as it accommodates and adheres to the itinerary of the trip. Grand Stores and the appointed travel agent reserve the right to refuse a flight route if it causes inconvenience to the planned itinerary.

o    Rooms will be booked on a single occupancy basis for each member and the hotels will be non-negotiable and will be decided on by the appointed travel agent. Should a traveler/ member wish to share a room with another traveler/member he may let the concerned travel agent know at the time of booking and the travel agent will then help look for other travelers who are willing to split the room costs (stay on a double occupancy basis) and will make the required arrangements. 

o    The itinerary of the trip is not flexible and all members travelling are expected to adhere to the itinerary and cooperate with the tour facilitator and photography instructor.

o    Once the flight routes, hotel stay and itinerary are confirmed by the member, the final price of the package will be provided by the appointed travel agent and will differ from country to country for each member and on that price each member can then avail the USD 500 discount.

o    The trip once booked and paid for, is non refundable under any circumstances.

o    Grand Stores, the travel agent or Nikon Middle East FZE do not shoulder any responsibility in case of any accidents, illness, diseases or fatality that any member may encounter on the trip. All members travelling are expected and required to issue their own travel insurance.

o    Grand Stores, the travel agent or Nikon Middle East FZE do not shoulder any responsibility in case of baggage loss, damage or theft during the entire trip. The member is required to take full responsibility for his belongings at all times and is expected to book an insurance that covers all liabilities.

 

 

 

o    The lens is to be borrowed and returned within not more than 3 days failing which Grand Stores will levy a penalty of USD 500 for each extra day that the member defaults until the lens is returned.

o    Once the loaned item is returned Grand Stores reserves 24 hours to thoroughly inspect the product during which if there’s any damages, the customer will be notified immediately and the customer will be liable to pay the service bill presented by Grand Stores.

o    In case of loss or complete damage to the product, the customer will be liable to pay the entire RRP of the product as stipulated by Grand Stores. The same applies in case of any damages caused by the customers neglect or mishandling- the value of the repairs will have to be paid by the customer and this value will be ascertained by Grand Stores. 

On the subsequent purchase of any Nikon Premium Product, the customer is required to update his online account and add the newly purchased product details corresponding with the NPM card number, after which the member can avail the following benefits for a period of 12 months after registration of the product. 

 

Article 5 – Redeeming 

In order to redeem all the benefits available, members need to only log in online to their account on www.npm-mea.com and manage all the bookings for travel, learn, service and loan right there. Once the bookings have been made by the members they will receive a notification email as to what the next course of action will be. Members need to follow the instructions there in and proceed to redeem their benefits. 

The Nikon Premium loyalty card is nonrefundable and cannot be exchanged for cash.

 

Article 6 – Loss, theft, damage 

The NPM member/cardholder is responsible for any loss, theft or damage of his loyalty cards and must immediately inform the stores if this occurs.


Grand Stores L.L.C. declines any responsibility or any obligation to replace the customer with a new membership card in the advent of the loss, theft or damage to the NPM card by the cardholder.
 

Article 7 – Removal 

The Nikon Premium membership loyalty card is the property of Grand Stores L.L.C. 

The Nikon Premium membership loyalty card can be immediately suspended or terminated by Grand Stores L.L.C at any time if, in Grand Stores L.L.C reasonable opinion, that a Card Member: 

 

Article 9 – Responsibility 

Grand Stores L.L.C. and Nikon is exempt from any responsibility for any direct or indirect consequences linked to any malfunction of the program; nevertheless it will do the best to keep all the members acquired benefits.

Grand Stores L.L.C. and Nikon is exempt from any responsibility for any direct or indirect consequences linked to any fraudulent use or non-accordance use with these terms and conditions.

 Article 10 – Terms and conditions modification or cancelation

Grand Stores L.L.C. reserves the right to modify some of the benefits of the NPM program or cancel/ discontinue the program in its entirety. In addition they reserve the right to amend some or all of these terms and conditions stipulated herein. 

Article 11- General

These terms and any disputes or claims arising out of, or in connection with, its subject matter or formation (including non-contractual disputes or claims) are governed by and construed in accordance with the law of the United Arab Emirates. 


Article 11- Indemnity

As a condition of use of this Website, you agree to indemnify us from and against any and all liabilities, expenses (including legal fees) and damages arising out of claims resulting from your use of this Website, including without limitation any claims alleging facts that if true would constitute a breach by you of these terms and conditions.
